Lori Carver Hershorin, a Partner of Hershorin & Henry, LLP, has extensive experience in litigation matters involving real estate, title issues, title insurance, fraud, breach of fiduciary duty, partnership issues, contract disputes, insurance bad faith and employment law (sexual harassment, pregnancy discrimination, wrongful termination, age discrimination). Ms. Hershorin has served as a Temporary Judge for the Orange County Superior Court since 1998. She also is a certified Court-Mediator for Orange County, Los Angeles County and Riverside County as well as an arbitrator for the Orange County and Riverside County Bar Associations for attorney’s fee disputes.
Ms. Hershorin has prevailed in 12 out of 12 Appeals over the last 10 years, and is responsible for the first published decisions in the State of California concerning the definition of “lack of access” under a title insurance policy and sub-escrow duties of a title insurance company, found in the published decisions are entitled Magna Enterprises v. Fidelity National Title Insurance Co. (2002) 104 Cal.App.4th 122 and Markowitz v. Fidelity National Title Insurance Company (2006) 142 Cal. App. 4th 508.
Ms. Hershorin began her legal career in 1991 at the prestigious Law Firm of McDermott, Will & Emery. As an associate, she worked on fraud cases through trial, contract disputes, employment issues and a real property matters.
She thereafter joined the Law Firm of Lewis D’Amato, Brisbois & Bisgaard wherein she worked on numerous mortgage fraud cases, real estate disputes and breach of contract cases.
In 1995, Ms. Hershorin became a member of the legal department of Fidelity National Title Insurance Company, a Fortune 300 company traded on the New York Stock Exchange. At that time, she was an Assistant Vice-President and Associate Counsel, and litigated hundreds of cases involving issues of real property (title and escrow), fraud, breach of fiduciary duty, insurance bad faith, business issues, breach of contract, complex business disputes, partnership disputes, and probate issues. She also supervised outside counsel and provided legal advice on a regular basis to the title and escrow operations concerning all topics ranging from title and escrow matters, claims, labor issues, business concerns, unfair competition claims, and employee theft. Ms. Hershorin conducted several arbitrations and trials, and prepared for numerous trials that were settled before trial commenced. Ms. Hershorin conducted hundreds of depositions, drafted all forms of pleadings and discovery.
In 1998, Ms. Hershorin was promoted and became one of two in-house employment law attorneys for Fidelity, as well as continued in her role as a litigation attorney for all types of real estate disputes and business concerns. In addition to the title and escrow litigation matters, she drafted several employment polices and procedures for the company, conducted investigations of employee-related claims of discrimination, sexual harassment and wrongful termination, and handled the day-to day employment questions from Fidelity’s personnel in the Operations. She additionally defended employment litigation lawsuits from the discovery phase through trial or arbitration.
In January 2000, Ms. Hershorin was promoted by Fidelity to a Vice-President, Senior Litigation Counsel and Litigation Manager for the Southwestern Region for the Company. While continuing to litigate in the areas of real estate, title, escrow, insurance bad faith and business disputes, Ms. Hershorin additionally assumed responsibility for the litigation departments in Southern California and Las Vegas, Nevada. Her management role entailed supervising litigation attorneys and staff, interfacing with claims attorneys, developing budgets, controlling expenses and costs, and interfacing with upper management on pending and potential litigation. In addition to these duties and her caseload, in January 2002, Ms. Hershorin was appointed as the Chairperson for the Nationwide Defalcation Task Force. This required heading a Steering Committee to draft a company policy governing defalcations, implementing the policy that was formed, supervising auditors, working with outside counsel in several states to recover stolen funds through the Court process and advising local Fidelity business operations concerning the investigation and operating procedure in light of the embezzlement in an effort to maximize recovery of embezzled funds. As a manager, Ms. Hershorin continued in her role as a litigation attorney and conducted numerous depositions, prepared for and attended mediations, drafted discovery, and all forms of pleadings including numerous motions for summary judgment and tried cases before an arbitrator or trial judge.
Since 2003, Ms. Hershorin has been the managing partner of Hershorin & Henry, LLP and her practice currently includes a general civil litigation practice involving real property issues, title issues, title insurance coverage, insurance bad faith, contracts, fraud, breach of duties as a real estate agent, negligence, breach of fiduciary duty, and employment (sexual harassment, pregnancy discrimination, wage and hour violations, overtime violations, Title VII issues, and wrongful termination.) She has represented both individuals and corporations with respect to these litigation matters. Ms. Hershorin also has drafted and prevailed on several appeals during her tenure with Hershorin & Henry, LLP. Ms. Hershorin has taken on the additional role of advising several clients on legal issues pertaining to escrow transactions and title issues. She also advises several corporations with regard to employment disputes and business matters. Moreover Ms. Hershorin has been retained by several clients to perform transactional work including drafting stock purchase agreements, corporate governance documents, employment handbooks, employment agreements, licensing agreements and severance agreements.
During her career, Ms. Hershorin has given several lectures on real property issues, developments in California law pertaining to the real estate industry, bad faith insurance litigation, prevention of sexual harassment, prevention of discrimination, elimination of bias, and general civil litigation procedures.
Ms. Hershorin is currently a member of the Orange County Bar Association within the Litigation, Insurance and Labor Sections. She is also a member of the Riverside County Bar Association and CLTA.
Ms. Hershorin was admitted to practice in California in 1991 and also in Indiana in 1991. She was admitted to practice in the U.S. Central and Southern District Courts of California in 1992.
