Ms. Wilcox joined Hershorin & Henry LLP in 2007 and brought to the firm over 30 years of extensive experience in civil litigation with a strong emphasis on real estate based claims and financial disputes. Since then, Ms. Wilcox has continued her litigation, trial and appellate practice in State and Federal courts. She was retained to recover $80+ million in losses on behalf of the FDIC arising from stated-income loans made by a failed thrift. Ms. Wilcox also continues to defend employment-based claims for the firm’s clientele and is a member of Professionals in Human Resources Association (“PIRHA”). In her practice, Ms. Wilcox represents commercial loan servicers in loan enforcement actions in State and Bankruptcy Courts. Ms. Wilcox also handles Trust and Will contests in the Probate Courts of Orange and Los Angeles Counties.
Prior to joining Hershorin & Henry LLP, Ms. Wilcox was a principal of Wilcox & Peirano LLP. She handled civil litigation and related appellate work involving real estate, commercial leases, consumer class action claims, and numerous trust and estates disputes. Ms. Wilcox represented a certified class of consumers in the published appellate decision of Patricia Lee v. Southern California University of Professional Studies (2007) 148 Cal.App.4th 782 in which the Court of Appeal upheld the Superior Court’s ruling in favor of the then putative Class Representative and denied enforcement of an arbitration contract that the defined class was not bound by. Eventually, the action settled after the class was certified.
Prior to establishing her own firm, Ms. Wilcox was a partner in McQueen & Ashman, LLP. Ms. Wilcox successfully litigated a wide range of business disputes and defended the interests of Conoco Phillips in numerous condemnation actions. The resolution of such claims often involved negotiating and drafting complex buy-sell agreements with licenses to deal with residual environmental issues. Her practice also encompassed business tort claims involving unfair competition, copyright infringement, commercial loan foreclosures and enforcement of commercial mechanic’s lien claims. Ms. Wilcox assisted in the appellate work that resulted in Howard S. Wright Constr. Co v. Sup. Ct. (2003) 106 Cal.App.4th 314 that upheld the contractor’s right to enforce its mechanic’s lien despite the property owner’s posting of a notice of non-responsibility.
As of counsel to Corbett, Steelman & Spector, Ms. Wilcox’s practice also involved civil litigation on behalf of employers dealing with employment-based claims involving ERISA, severance plans, wrongful termination and sexual harassment, appellate work, commercial loan recovery and work-outs, creditor bankruptcy rights, and construction disputes arising from public and private works of improvement.
During the first Bank & Thrift Crisis, Ms. Wilcox served as a Senior Attorney with the Federal Deposit Insurance Corporation. She litigated claims in federal and state courts to liquidate major assets of failed banks and thrifts. Ms. Wilcox has lectured before the OC Building Owners Management Association and various Southern California Escrow Associations.
Ms. Wilcox obtained her Juris Doctor degree from Loyola Law School in 1980. That same year she won the First Annual Trial Advocacy Competition the school held. Ms. Wilcox was admitted to the California Bar in May 1981. While attending law school, Ms. Wilcox co-authored, illustrated and published The Poorman’s Guide to Gourmet Dining on the Westside of Town (1980) that became an L.A. Times Bestseller and The Poorman’s Guide to Gourmet Dining in Pasadena (1979).
